The month of June saw our firm turn 5 years old, what a fantastic journey is has been, thank you to all our loyal clients and staff who have been part of the journey, here’s to the next 5 years!
 
The big news for July in the real estate industry is no doubt the 75 basis points increase in the repo rate, announced last week by the Reserve Bank. To date, we have seen little impact on the market with plenty of opportunities still available to Property Practitioners.

“No FFC without B-BBEE”

Dear Valued Clients & Friends, 
The topic of the last few months has been B-BBEE Compliance for Estate Agencies. The new PPRA, which came into operation on 1 February 2022, requires that a B-BBEE Certificate must be included in the application for an agency’s FFC. Real estate agencies have until the end of October 2022 to obtain a B-BBEE certificate to be eligible for their next three-year Fidelity Fund Certificates (FFCs). It is therefore vital that all owners of estate agencies start preparing themselves for compliance.
At this stage, the PPRA has not been clear on what exactly a “valid BEE certificate” means for Estate Agencies, as they have not stipulated a particular contribution level or whether a ‘non-compliant’ finding will be accepted. What is certain though, is that the PPRA is committed to short and long-term transformation in the industry, and whatever requirements are set will become more stringent with each three-year FFC application. It is highly probable that estate agencies will have to show a strategic commitment to transformation through continuous improvement of their B-BBEE status.
With the launch of our Phoenix B-BBEE Advisory service, we will look to partner with business owners of estate agencies to assist them in their B-BBEE Compliance goals for both the upcoming Oct-22 FFC application, as well as providing regular feedback and advice on their long-term B-BBEE strategic direction. This will ensure maximization of the B-BBEE scoring for each year within the 3-year FFC cycle.
Skills Development is a major contributor to the B-BBEE scorecard, and should be a key focus for estate agencies going forward. There are many benefits for business owners to focus on this area, particularly with the additional tax rebates of up to R40,000 per learner per year for interns doing their NQF4 qualification. This is an additional service that Phoenix can provide business owners.

LOOKING BACK ON LITIGATION
 

 
As we approach the second half of 2022, we stand in awe of the successes and lessons that we have encountered for the past 6 months. There have been massive developments in various aspects of the law and we at Van Deventer and Van Deventer Incorporated pride ourselves to always deliver the best possible outcomes to our clients, despite any changes and “curve balls” that may be thrown our way.
 
Some of the team highlights for the past few months include:
 

  1. Restoration of a deregistered Close Corporation – Client approached our offices with relevance to an immovable property being pinned down in a deregistered Close Corporation. Our offices proceeded to institute an Application in the Johannesburg High Court for the re-registration of the Close Corporation and simultaneously the restoration of the property therein. Order successfully obtained.  
  2. Eviction – Our offices successfully obtained an Eviction Order from the High Court of Johannesburg. The Order provided the unlawful occupiers 30 days to vacate the premises. The occupiers failed to abide by the court order and the times as stipulated therein, having our offices instruct the Sheriff and an applicable Policing Unit to assist with removing the unlawful occupants. The eviction was successfully executed with the assistance of the Sheriff and members of the police. A very well deserved congratulations to Roulton’s team for excellent services rendered herein.  
  3. Rescission of Judgement – Client approached our offices having informed us of a Default Judgement granted against her and her Company. Our offices were instructed to have such Default Judgement rescinded in the Wynberg Magistrates Court, Cape Town. Our Johannesburg offices assisted client and successfully obtained the Rescission of Judgement Order after same was vigorously opposed by counterpart.  
  4. Divorce – Our offices instituted divorce proceedings in the Pretoria Magistrates Court, whereby a minor child and immovable property where of concern. After persistent litigation did our offices obtain a successful Decree of Divorce whereby our client received primary custody and care over the minor child and additional to that, the matrimonial property of the joint estate was to forfeited to our client.  
  5. Section 65 Application – Our offices successfully obtained Default Judgement against a debtor, in which the debtor failed to satisfy the debt as per the Order/Judgement granted. We were subsequently instructed to institute a Section 65 Application. These proceedings are applicable in matters where there is an original judgement ordering the payment of an amount of money, in a lump sum or in specified instalments, and the order has not been complied with within ten court days of the date on which the judgement was granted. On the date of the hearing the debtor conceded and presented a settlement proposal, which our client accepted and the terms thereof made an order of Court.  
  6. Mediation/Separation and Parental Plan – Our offices successfully performed a mediation between two parties of which living arrangements, finances and a minor child was of concern. After various significant mediation sessions, the parties were able to come to an agreement in terms of all the issues that were in dispute. Our offices are subsequently in the process of having the terms incorporated in a Parental Plan, and having same made an order of court.  
  7. Undoubtedly the shared highlight for the Team in general has been the wonderful additions of Ryleigh and Fatima as team members.  
  8. Another big highlight for Seetal’s team has also been securing a ‘Retainer Client’, who is considered “a leader in the market”. We are now taking instructions for their collection matters from all over the country. Thus far the team has managed to receive multiple settlement offers in favour of our client. 

 
Our team has seen more than their fair share of “interesting” cases, which left them at a loss for words some days. However, the true highlight has been seeing each other grow as individuals and as a team is inspiring. The level of cohesion has been nothing short of frictionless. Ann-Suhet wishes to use this opportunity to thank her team for their dedication and willingness to always walk an extra mile during the last couple of months. Q1 of 2022 started with a bang. With COVID measures slowly but surely decreasing there was a positivity all round the Western Cape. Property sales did well and our Conveyancing department was very busy throughout. All the Public and School Holidays in April 2022, although necessary to rest, impacted business and a dip was experienced.
 
Just as May appeared to blossom in the Autumn sun, a 50 Basis Point Repo Hike brought a sense of realism, especially with, what seems to be, a very wet and cold Cape winter.
 
The Van Deventer & Van Deventer Cape Town branch has expanded its Debt Collection Department with a focus on retail, banking, school and tertiary fee debt collection. Let us know how we can assist in this very important part of every business.
